Draft Mining Regulations consultation

The Department for Energy and Mining (DEM) has now commenced public consultation on draft mining regulations to support the Statues Amendment (Mineral Resources) Act 2019, that will come into force in January 2021. 

Of interest to GPSA members, the draft mining regulations regarding access to agricultural land were published on Monday, 3 August 2020 and can be accessed here.

The draft regulations outline how the provisions of the revised Mining Act are applied. By law, the regulations cannot raise new issues and topics outside the scope of the updated Mining Act. 

GPSA has engaged our Mining Taskforce to inform our policy position on the draft regulations and to prepare a written submission on behalf of South Australian grain producers.

GPSA will continue to advocate for a better balance between competing land use interests. While the regulations must be consistent with the framework set out in the Act, GPSA believes there is scope for these regulations to improve the process of exploration and resource extraction for landowners.

GPSA continues to push for an independent review into SA’s mining law. This review should, among other things, thoroughly examine best practice land access frameworks in NSW, Qld and WA.
